Terms of Use

1. Acceptance of Terms

By downloading, installing, accessing, or using the Tiiks mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("User", "you") and Tiiks ("Company", "we", "us", "our"), the operator of the App.

3. Eligibility

You must be at least 16 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have obtained parental or guardian consent to use the App.

4. User Accounts

To use the App, you must authenticate via Strava. By connecting your Strava account, you authorize us to access your profile information and activity data as permitted by the Strava API.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Subscription Plans

The App offers Basic and Pro subscription plans. Basic plans are subject to distance and time-period limits. Pro plans may include additional features, higher limits, or access to paid content.

Subscription fees, billing cycles, and cancellation policies will be presented to you prior to purchase. Mobile in-app purchases are processed through the Apple App Store or Google Play Store and are subject to their respective terms. We use RevenueCat as our subscription management provider and, where applicable (for example, web checkout availability), Stripe as a payment processor.

Payments for subscriptions purchased via the Apple App Store are processed by Apple and are subject to Apple's terms and conditions. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage or cancel subscriptions through your Apple ID account settings.

Payments for subscriptions purchased via Google Play are processed by Google and are subject to Google Play terms and conditions. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage or cancel subscriptions through your Google Play account settings.

For users in the European Union, you have the right to withdraw from a digital purchase within 14 days without giving any reason. However, by purchasing a subscription and requesting immediate access to digital content, you expressly consent to waive your right of withdrawal once the service has been fully performed.

Prices may include or exclude applicable taxes (such as VAT) depending on your location. Where required, taxes will be calculated and displayed at checkout.

All purchases are final unless required otherwise by applicable law. Refunds for purchases made via Apple App Store or Google Play are handled by the respective platform. Refunds for purchases made via Stripe are handled in accordance with applicable consumer protection laws. Where required by law, you may be entitled to a refund.

We reserve the right to modify pricing and plan features. Existing subscribers will be notified of material changes at least 30 days in advance.

You may submit reviews, ratings, and other content ("User Content") through the App. You retain ownership of your User Content, but grant us a worldwide, non-exclusive, royalty-free, perpetual license to use, display, reproduce, and distribute your User Content in connection with the App.

You represent that your User Content does not violate any third-party rights and complies with applicable laws. We reserve the right to remove any User Content that violates these Terms.

8. Third-Party Services

The App integrates with third-party services including Strava. Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

Use of Strava data is subject to the Strava API Agreement. We only access data necessary to provide core functionality and do not use Strava data for advertising purposes.

We may modify or discontinue integrations with third-party services at any time.

Strava is a registered trademark of Strava, Inc. The App is not endorsed by or affiliated with Strava, Inc.

9. Intellectual Property

The App and its original content (excluding User Content), features, and functionality are owned by Tiiks and are protected by international copyright, trademark, and other intellectual property laws.

The Tiiks name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Tiiks. You may not use such marks without our prior written permission.

10. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the App will be available at all times or free from interruptions. We may suspend or restrict access for maintenance, updates, or technical reasons.

Bicycle maintenance decisions should always incorporate your own inspection and professional mechanical advice. The App is an informational tool and does not replace professional bicycle maintenance services.

11. Limitation of Liability

TO THE EXTENT PERMITTED BY APPLICABLE LAW IN YOUR JURISDICTION, IN NO EVENT SHALL TIIKS, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Our total aggregate liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless Tiiks and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the App, your violation of these Terms, or your violation of any third-party rights.

We shall not be liable for any failure or delay in performance resulting from events beyond our reasonable control, including but not limited to natural disasters, internet outages, or third-party service failures.

13. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice, for legitimate reasons, including conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use the App will immediately cease. You may request deletion of your data in accordance with our Privacy Policy.

You may request deletion of your account at any time directly within the App or by contacting us. Account deletion will result in permanent removal of your data as described in the Privacy Policy. We process deletion requests within 30 days.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Poland, with applicable European Union law, without regard to conflict of law principles.

For users in the European Union, nothing in these Terms affects your statutory rights as a consumer under applicable EU law, including the Consumer Rights Directive (2011/83/EU).

To the extent permitted by applicable law, you agree to resolve disputes with us on an individual basis.

If mandatory consumer-protection, privacy, or other local laws in your country of residence grant you additional rights or remedies, those mandatory rights prevail over conflicting provisions of these Terms.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting a notice within the App or sending you a notification at least 30 days before the changes take effect.

Your continued use of the App after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the App.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.
